Match Day Mania (MDM) Campaign/Offer Terms & Conditions

1. Bundl Technologies Private Limited (hereinafter referred to as “Swiggy”, “We”, “Our”, “Us”) is introducing the Match Day Mania  campaign to be held from 19th September, 2020  to 10th  November, 2020 (Finals of Match Day Mania) (“Campaign”), wherein the users (hereinafter referred to as “You”, “Your” or “User/s”) gets an opportunity to avail certain offers and benefits including but not limited discount coupons and cashback, being offered to the Users on Swiggy’s platform (“Platform”), subject to the terms and conditions mentioned herein below (“T&Cs”). 

2. This document is an electronic record in terms of Information Technology Act, 2000, and the Rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

3. We reserve the right, at our sole discretion, to terminate, amend or extend, modify, add or remove portions of this T&C or Campaign, at any time without any prior written notice to You. 

4. By participating in this Campaign, the Users agree to be bound by these T&Cs, the Terms of Use, Privacy Policy and other relevant documentation that are available on www.swiggy.com including any modifications, alterations or updates that we make.

1. I. Coupons and Cashbacks: 
   • Different coupons available during the Campaign are limited to uses frequency and discount amount;
   • A given coupon can only be redeemed a limited number of times per user and for limited discount amount;
   • A given coupon may have it’s own ‘minimum order value’ to be applicable for an order;
   • A coupon may not be applicable to all restaurants on the Platform and can be only used for select restaurants where it’s indicated to be used; 
   • A coupon construct – discount amount, validity and uses scope is subject to change and can be modified / discontinued without any prior notification;  
   • Cashbacks: The cashback is an offer extended by respective digital wallet and bank partners; 
   • Cashback is limited by uses frequency and amount of cashbacks a User can get;  
   • The cashback or coupon is no way part of the service / order placed by Users through the Platform  and is an additional benefit being voluntarily offered to selected Users;
   • The Cashback constructs is subject to change, modification or can be discontinued without any prior notice by the respective digital wallets / banks or by Swiggy; 
   • Any dispute related to cashbacks or bank card discount can be raised to respective wallets or banks; 
   • Swiggy Money cashbacks will be credited in Your Swiggy Money wallet and teh use of money and cashback will be subject to  the wallet terms and conditions.

II. Deal of the Day:

1. Deal of the Day is a virtual event where a restaurant brand or group of restaurant brands may offer additional discounts/value to Users for a given day
2. The offers are given by respective restaurant brands voluntarily for a specific time duration and day. 
3. The construct of the segment is subject to change, modification or can be discontinued by the restaurant brand or Swiggy without any prior notification.

III. Great Brand Great Deals:

1. The section is a collection of restaurants with good customer ratings and best offers for Users; 
2. The collection is exclusive to restaurants participating in the  Campaign.

IV. Curated for you:

1. The section consistsconsist of  different cuisines restaurants participating in the  Campaign and providing offers to the Users. 

V.  Best Brand on Offers:

1. The section consists of multi-chain / multi-outlet brands those participating in the  Campaign and providing offers to the Users

VI  Deal for two / Deal for Many: 

1. The section is a collection of restaurants offering additional discount with coupon codes JUMBO and OR PARPY

VII: Get Match Ready:

1. Get Match Ready  is a virtual event where a restaurant brand or group of restaurant brands may offer additional discounts/value discounts/value to Users for a given time period in a day 
2. The offers are given by respective restaurant brands voluntarily for specific time duration and day. 
3. The construct of the segment is subject to change, modification or can be discontinued by the restaurant brand or Swiggy without any prior notification.

VIII: Match Day Combos:

1. The section is a collection of restaurants offering item combos in their menu at a discounted price 

IX : Swiggy Exclusive / Only on Swiggy:

1. The section is a collection of restaurants exclusive to Swiggy Platform and offering certain offers during the campaign  

X:  Fine Dining Finner Deals: 

1. The section is for the premium category of restaurants on offers 

XI: Sunny Side up:

1. The collection will feature restaurants known for break fast and the collection will be visible during breakfast slot 

XII: New in your area:

1. The collection would feature newly launched restaurants on the platform 

XIII: Best Brands Best Offers:

1. The collection will feature best brands on their rating and popularity , those are also giving offers during the campaign 

XIV: Pizza Week:

1. This is cuisine first collection, for example ‘Pizza Week’ collection will feature restaurant primarily known for Pizza 

XV: Curated for you:

1. The widget highlights different cuisines in under different categories like Pizza, Biryani etc, the restaurants geeting featured here are basis their primary offering for a cuisines and discounts offer during the campaign 

XVI: Bank and Payment offers:

1. The section highlights discount / cashback offers from payment partners 

XVII: Cricket Quiz:

1. The section takes users to a Cricket Quiz flow, where user could guess the correct answer and stand a chance to win rewards from Paytm First Games and Swiggy.

XVIII: Swiggy Perks:

1. The section highlights 3P offers (3rd Party Brands) which user may avail by using given coupon in the section 

XIX: InItToWinIt:

1. The section is for the WinIt Raffle Campaign, users can ‘order and stand a chance to win exciting gifts’ valid on every weekend during Match Day Mania.

1. The section is a vertical collection of restaurants those are promoted ( ads) and offering discounts too 
2. The backup of the collection is to ‘all offers’ 

Please note:

The Campaign is an initiative of Swiggy & restaurants brands participation  and discounts from restaurants is voluntary and subject to change, modification and can be discontinued without any prior notice.

The participation of Digital Wallets and Banks is voluntary, discounts and cashback from them is a voluntary offer and subject to change,modification and can be discontinued without any prior notice.

5. To participate in the Campaign, You need to fulfill the following criteria: 

 i. You shall be a Swiggy user;

Ii. You are competent to contract as mandated by the Indian Contract Act, 1872 and is of the age of 18 years or above; 

iii. You shall be in whole compliance of and adhere to all laws and regulations; and

Iv. That you have never been convicted of any crime under the Indian Penal Code, 1860.

6. The User shall not damage or misuse any intellectual property rights belonging to Swiggy.  All trademarks, trade names, logos, slogans, symbols etc being displayed on the Platform are the exclusive property of Swiggy and cannot be copied or used  for any purpose whatsoever and any unauthorized usage would amount to an “unlawful act” under the applicable law.

7. There is no cash alternative to the prize/benefits hereunder. Further, such benefits do not give any additional guarantee or warranty and are non- transferable.

8. Swiggy shall not be responsible for any loss, injury or any other liability arising due to participation by any person in the Campaign.

9. You hereby agree to indemnify and keep Swiggy harmless against all damages, liabilities, costs, expenses, claims, suits and proceedings (including reasonable attorney’s fee) that may be suffered by Swiggy as a consequence of (i) violation of the terms of this Policy by You; (ii) violation of applicable laws; (iii) any action or inaction resulting in willful misconduct or negligence on Your part.

10. This T&C and the Campaign shall be governed in accordance with the applicable laws in India. Courts at Bangalore shall have the exclusive jurisdiction to settle any dispute that may arise under this T&C and relating to the Campaign. 

Terms & Conditions (Cricket Quiz powered by Paytm First Games)

Bundl Technologies Private Limited (hereinafter referred to as “Swiggy”, “We”, “Our”, “Us”) is  introducing a Cricket Quiz powered by Paytm First Games, with three kind of prizes namely daily assured prizes, mega prize of the day and bumper prize of the season (“Contest”) from 10^th October, 2020 to 10^th November, 2020, wherein the User (hereinafter referred to as “You”, “Your” or “Customer”) gets an opportunity  to play the Contest on  Swiggy’s platform (“Platform”) under the tab “Match Day Mania” and win exciting prizes as described below, subject to the terms and conditions mentioned below (“T&Cs”).

4. To participate in the Contest, You need to fulfil the following criteria: 

1. you need to be a Swiggy User;
2. you must be competent to contract as mandated by the Indian Contract Act, 1872; 
3. you shall be in whole compliance of and adhere to all laws and regulations of the land; 
4. you should have never been convicted of any offence under the Indian Penal Code, 1860; and
5. Employees of Swiggy and their family members are not eligible to participate in the Contest. 

5. Swiggy reserves the right, in its sole discretion, to disqualify any participant User that tampers or attempts to tamper with the Contest or violates the T&Cs.

6. The terms of participating in the Contest and prizes are as follows: 

1. Platform: Swiggy;
2. Contest Partner: Paytm First Games;
3. Contest: Cricket Quiz powered by Paytm First Games;
4. How to play:  

Step 1: On the Platform, User needs to click on Cricket Quiz powered by Paytm First Games under the tab Match Day Mania;

Step 2: User will be given a quiz question with 2 (Two) options for the answer where User will have to select 1 (One) option and click on submit to submit the response;

5. Prizes: 

1. Daily assured prize: Every User who wins the quiz will get an assured prize of flat Rs. 50 Paytm First Games bonus cash issued by Paytm First Games;
2. Mega prize of the day i.e. Rs. 5000 Paytm First Games bonus cash (issued by Paytm First Games) and Rs. 1000 Swiggy Money: To become eligible for mega prize of the day, User will have to win the quiz and place an order (any order) through the Platform within the same day (from 12 :00 AM IST  to 11:59 PM IST) of winning the quiz.  One lucky winner out of all eligible Users will win mega prize of the day; and
3. Bumper prize of the season i.e. cricket bat signed by Sachin Tendulkar: To become eligible for bumper prize of the season, User will have to win the quiz and place an order (any order) through the Platform within the same day (from 12 :00 AM IST to 11:59 PM IST) of winning the quiz.  One lucky winner out of all eligible Users will win bumper prize of the season;

Note: 

1. The Users winning the quiz and placing an order within the same day (from 12:00 AM IST to 11:59 PM IST) of winning the quiz shall automatically become eligible for mega prize of the day and bumper prize of the season. 
2. The lucky winners for mega prize of the day and bumper prize of the season shall be chosen based on draw of lots and Swiggy’s decision in selection of the winners shall be final. 
3. Placing multiple orders within the same day of participating and winning the quiz will not increase your chances of winning mega prize of the day and/or bumper prize of the season. The lucky winners of mega prize of the day and/or bumper prize of the season will be chosen purely based on draw of lots.
4. Duration:  10^th October, 2020 to 10th November 2020 (will be available till 11:59 Pm of 10^th November 2020).

7. Announcement of winners: Winners will be communicated through an email about the prizes they have won. The winner of mega prize of the day shall be announced on Swiggy’s blog on the next day of winning the Contest. The winner of Bumper Prize of the season will be announced on Swiggy’s blog by 15^th November, 2020 of the end of the Duration. Subsequently, Swiggy may contact the winners through an e-mail and a phone call to communicate about their prizes and how to claim the prizes. Notwithstanding anything contained herein, it shall be the sole responsibility of the Users to check the blog for the results/updates posted by Swiggy. 

8. If Swiggy is unable to reach to you on the contact details shared by you and you fail to claim your prize within 15 days of the announcement of the winners, the prizes will be deemed unclaimed and Swiggy reserves the right to distribute the prize to other eligible Users based on lucky draw. 

9. By participating in the Contest, you consent to share your name (and masked phone number) on Swiggy’s blog for announcement of the winners, if you are chosen as a winner.

10. You understand that we do not make any assurances as to the probability of winning the Mega Prize of the day and/or Bumper Prize of the season and selection of the winners will be based on draw of lots.  
11. We do not collect any participation fees from you for participating in the Contest.

12. Your participation in the Contest is entirely voluntary.

13. Products on our Platform are available to You even if you do not participate in the Contest. 

14. In the event of any queries relating to the Contest, you may reach out to us through the ‘Contact Us’ section on the Swiggy application and website.

15. Redemption of Paytm First Games bonus cash shall be subject to terms and conditions applicable on Paytm First Games’ platform. Any issues with respect to redemption of Paytm First Games bonus cash, shall be addressed to Paytm First Games and Swiggy shall have no role, responsibility, liability and obligation in this regard.

16. Disclaimer: All rights in the names, images contained in the marketing/promotional material are reserved with the respective intellectual property right owners. 

17. All rights with respect to selection of the winner shall vest with us and shall be done as per the procedure adopted in our sole discretion. Our decision in this regard will be final.

18. This Contest is valid in all cities/states except in the state of Tamil Nadu. 

19. The User shall not damage or misuse of intellectual property rights belonging to Us or any third party. All trademarks, trade names, logos, slogans, symbols etc being displayed on page are the exclusive property of Swiggy and cannot be copied or used by any third party for any purpose whatsoever and any unauthorized usage would amount to an “unlawful act” under the applicable law.

20. There is no cash alternative to the prize / benefits hereunder. Further, such benefits do not give any additional guarantee or warranty and are non- transferable.

21. Swiggy shall not be responsible for any loss, injury or any other liability arising due to participation by any person in the Contest.

22. You hereby agree to indemnify and keep Swiggy harmless against all damages, liabilities, costs, expenses, claims, suits and proceedings (including reasonable attorney’s fee) that may be suffered by Swiggy as a consequence of (i) violation of terms of these T&Cs by You; (ii) violation of applicable laws; (iii) any action or inaction resulting due to wilful misconduct or negligence on Your part.

23. These T&Cs shall be governed in accordance with the applicable laws in India. Courts at Bangalore shall have the exclusive jurisdiction to settle any dispute that may arise under these T&Cs.
