Bundl Technologies Private Limited (hereinafter referred to as “Swiggy”, “The Bowl Company”, “We”, “Our”, “Us”) reserves the right, at its sole discretion, to terminate, amend or extend, modify, add, or remove portions of this terms & conditions or this offer (defined below), at any time without any prior written notice to You.
By participating to avail this offer, all participant User(s)(defined below) agree to be bound by these terms and conditions (“T&Cs”), the Terms of Use, Privacy Policy and other relevant Swiggy policies and documentations that are available on www.swiggy.com and on its mobile application (“Platform”) including any modifications, alterations or updates that We make (collectively referred to as “Swiggy T&C’s”).
1. Details of the Offer:
“BowlMeOver Match Mania” offer (“Offer”) commences at 11:30 AM on 10th November 2022 and will remain live until stocks last on 10th November 2022 (“Offer Period”) on the Swiggy application. This Offer is available and extended to users ordering food for delivery in the following cities – Bangalore and Hyderabad only (each a “City”) and having access to and ordering through the Swiggy application (hereinafter referred to as “You”, “Your” or “User”) subject to and in accordance with the T&Cs mentioned below –
- The Offer will be live only during the Offer Period.
- Steps to avail: Users must successfully transact with items from only The Bowl Company Menu and have a pre-discount item total of above Rs.749 (exclusive of GST).
- Users can club the Offer with other prevalent coupons, they are otherwise eligible to avail on the platform.
- First One Hundred and Fifty-One (151) Users on the day of the Offer Period (“Entry Limit”) to follow the above T&Cs, to get a complimentary Indian Cricket team cap* (“Freebie”) which will be delivered along with their order, on 10th November 2022 until stocks last in the relevant region.
- We reserve the right to suspend, end or withdraw the Offer for/on that particular day during/ within the offer Period, if and when the Entry Limit is achieved or for any other reasons.
2. Relevant terms and conditions:
- This Offer is not valid in the state of Tamil Nadu.
- No responsibility is accepted for the orders that are late, lost, misdirected or not received by Us during the Offer Period.
- The Users understand that We do not make any assurances as to the probability of winning in this Offer or regarding the quality of the Freebie.
- We do not collect any additional participation fees for the Offer.
- Availing this Offer is entirely voluntary and will be construed as an acceptance of the Swiggy T&C’s.
- There is no cash or other alternative to the Freebie hereunder. Further, such Freebies do not give any additional guarantee or warranty regarding the products sold on the Swiggy app and are non-transferable.
- In the event of any queries relating to the Offer, You may reach out to Us through the ‘Contact Us’ section on the Swiggy application and website or via The Bowl Company Instagram DM.
3. The visuals, pictures, etc., shown on the Platform or otherwise are for promotional purposes only and shall not be construed as the exact representation of the Freebie.
4. You shall not make any demand in respect of the make, variation in sizes, or otherwise the physical features in respect of the Freebie that he/she has won.
5. Swiggy shall not be responsible for any loss, injury or any other liability arising due to availing or participation by any User in the Offer, whether direct or indirect.
6. We assume no responsibility for any technical error, omission, interruption, deletion, defect, delay, loss or damage in the operation of the website and/or participation in the Offer. If for any reason the Offer is not capable of being run as planned, due to causes beyond the reasonable control of Us, We may modify, suspend, terminate or recommence the Offer without any further notice.
7. You hereby agree to indemnify and keep Swiggy harmless against all damages, liabilities, costs, expenses, claims, suits and proceedings (including reasonable attorney’s fee) that may be suffered by Swiggy as a consequence of (i) violation of the terms of this T&Cs or any other policy by You; (ii) violation of applicable laws; (iii) any action or inaction resulting in willful misconduct or negligence on Your part and/or (iv) any third party claims.
8. These T&Cs shall be governed in accordance with the applicable laws in India. Courts at Bangalore shall have the exclusive jurisdiction to settle any dispute that may arise under these T&Cs.
9. Under no circumstance shall Swiggy and/or their directors, employees, officers, affiliates or subsidiaries, be liable to the User and/or any third party for any lost profits or lost opportunity, indirect, special, consequential, incidental, or punitive damages whatsoever, even if Swiggy has been advised of the possibility of such damages.
